Mahungela murder trial delayed again over outstanding court transcripts

The murder trial of 23-year-old, Bafana Mahungela, has once again been postponed in the Johannesburg High Court due to outstanding court transcripts and ongoing consultations between the defence and the accused.

Mahungela appeared in court on Monday, where he stands accused of the murder of Johannesburg teacher, Kirsten Kluyts. Her body was discovered near George Lea Park in Parkmore after she participated in an athletics event in 2023.

During the brief proceedings, the State confirmed that only some of the outstanding transcripts from earlier hearings at the Palm Ridge Magistrates’ Court had been received, while other were still missing.

State prosecutor, Siyabonga Futshana, also informed the court that Section 220 admissions linked to video footage evidence had been handed to the defence. However, Mahungela’s legal representative requested additional time to consult with the accused before the matter could proceed.

The defence told the court it was still unable to properly prepare for trial due to the missing transcripts and incomplete consultations.

Judge, Ian Cox, subsequently postponed the matter to Tuesday, while expressing concern over repeated delays affecting the progress of the trial. He also urged transcription services to urgently provide the outstanding records, warning that the matter could not face endless postponements.

“Hopefully everything will be sorted by today. I really do hope so. So we’re going to roll the matter until tomorrow for transcripts as well as further trial in custody until then,” the judge said.

Mahungela has pleaded not guilty to charges including murder, attempted rape, kidnapping, and robbery with aggravating circumstances.
