Mogotsi’s fourth attempt at bail falls flat

The Johannesburg Magistrate’s Court has denied North West businessman, Brown Mogotsi, bail for the fourth time.

The court ruled that Mogotsi’s inconsistent residential addresses, coupled with concerns that he poses a flight risk, weighed heavily against his latest bid for release.

In his application, the self-proclaimed political fixer presented two new residential addresses as “new facts”, after the addresses he had previously provided could not be verified by investigators.

However the court found that the addresses did not constitute new facts.

It also found that Mogotsi could not be trusted, saying he had failed from the outset to provide a trustworthy, reliable and verifiable residential address.

Mogotsi also accused the investigating officer of conducting a personal vendetta against him and making a false allegations that he tried to escape from court custody while disguised as a Correctional Services officer.

State prosecutor, Thami Mpekana, told the court that Correctional Services alerted authorities on 20 August that Mogotsi was allegedly planning to escape from custody.

According to the affidavit, Mogotsi allegedly intended to disguise himself in a Correctional Services uniform and walk out of the court cells. Officials subsequently placed him in leg irons after being alerted to the alleged plan.

The court described Mogotsi’s claim of a personal vendetta as far-fetched and unsupported by any evidence.

Mogotsi faces charges of perjury and defeating the ends of justice over allegations that he staged his own assassination attempt in Vosloorus last year.

Prosecutors argued that releasing him could jeopardise the investigation, while the defence maintains he is being unfairly targeted.

Mogotsi remains in custody and is expected back in court on 1 October.
