Alleged political fixer, Brown Mogotsi, will remain behind bars after the Johannesburg Magistrate’s Court denied his bail application, finding that he failed to show that the interests of justice favoured his release and that the State had presented a strong case against him.
Delivering judgment on Thursday, Magistrate Annelise Thlapi, raised concerns over conflicting residential addresses provided by Mogotsi and his wife, as well as evidence suggesting investigators struggled to verify his whereabouts during their investigation.
“There are three different addresses here provided by the applicant. All three addresses, they don’t correspond. The applicant failed to prove before this court that he has a proper address. The court cannot accept the applicant’s version that it is an error by the landlord to write a wrong address as house number 4454 in the lease agreement.”
The court found that these discrepancies raised concerns that Mogotsi could evade trial if released on bail.
Thlapi also considered the strength of the State’s case, including ballistic evidence allegedly linking cartridges recovered from the scene of Mogotsi’s reported assassination attempt in Vosloorus last year to other serious criminal investigations.
The 47-year-old businessman faces charges of unlawful possession of a firearm and ammunition, defeating the ends of justice and perjury. Prosecutors allege that Mogotsi staged his own attempted assassination in November last year, allegations he has consistently denied.
The National Prosecuting Authority (NPA) welcomed the ruling, describing it as an important step in ensuring accountability as criminal proceedings continue.
NPA spokesperson, Magaboke Mohlatlole, said the decision reflected both the seriousness of the charges and the strength of the evidence presented before the court.
“The NPA welcomes the decision of the Johannesburg Magistrates’ Court to deny bail to businessman Brown Mogotsi. This outcome underscores the seriousness of the charges he is facing.”

Despite the setback, Mogotsi’s legal team has already indicated its intention to challenge the ruling.
Attorney, Makau Sekgatja, dismissed the concerns surrounding his client’s residential address as a clerical error and argued that investigators were ultimately able to locate the property using the information provided to the court.
“When they (investigators) went to the address, the wife of Mr Mogotsi clarified to say the address is actually 4544. So there’s one thing which is common, three fours and one five. It’s something which is an honest mistake, one can say and not necessarily that Mr Mogotsi was being dishonest.”
Sekgatja confirmed that the defence has instructed counsel to begin the appeal process and is obtaining court transcripts, exhibits and other records required to proceed.
Mogotsi was arrested shortly after appearing before the Madlanga Commission of Inquiry and maintains that he was the victim of a genuine assassination attempt rather than the architect of a staged shooting.
Having spent 23 days in custody awaiting judgment, he will remain behind bars pending further court proceedings. Mogotsi is expected to return to the Johannesburg Magistrate’s Court on 12 June for trial preparations.
