The Economic Freedom Fighters (EFF) has requested that a motion of no confidence be tabled against National Assembly speaker, Thoko Didiza, over her decision not to oppose the President Cyril Ramaphosa’s court bid to halt the Section 89 impeachment process against him.

The red berets have written to the Deputy speaker, Annelie Lotriet, arguing that Didiza failed to defend Parliament’s constitutional role in one of the country’s most significant accountability processes.

President Ramaphosa has since approached the Western Cape High Court to interdict Section 89 proceedings linked to the Phala Phala farm saga while the findings of an independent panel report remain under judicial review.

The speaker resolved to file a notice to abide by an explanatory affidavit, which is intended to assist the court in considering aspects it must consider to make its final determination on whether the National Assembly must proceed with the impeachment process.

The EFF says the Speaker’s decision amounts to a failure to protect Parliament’s institutional independence.

EFF leader, Julius Malema, argues that Didiza chose partisan political interests over Parliament’s constitutional obligations by declining to oppose the President’s application.

Meanwhile, the Chairperson of the Impeachment Committee, Makashule Gana, has filed an affidavit opposing the President’s urgent application to interdict the committee.

Gana says the committee received legal advice recommending that it oppose the application to defend its constitutional mandate.

The matter is scheduled to be heard in the Western Cape High Court on 15 and 16 July.
