Alleged tenderpreneur, Hangwani Morgan Maumela’s, multi-million Ferrari could soon be sold as the legal battle over assets allegedly linked to the Tembisa Hospital looting intensifies.

The Special Investigating Unit (SIU) on Monday welcomed the Pretoria High Court’s dismissal of Maumela and the MHR Maumela Family Trust’s bid to stop the sale of the Ferrari SF90 Stradale, worth an estimated R11 million.

The pair approached the court in a bid to prevent the luxury vehicle from being sold while they appeal a Special Tribunal preservation order. They argued that the Ferrari could lose value if sold before the appeal was finalised.

However, the High Court found that they had failed to establish a clear right to stop the sale, demonstrate reasonable prospects of success on appeal or show that they would suffer irreparable harm.

The court further found that the tribunal’s interim preservation order is not automatically suspended simply because an appeal has been lodged.

The Ferrari is among a string of assets frozen as part of the SIU’s investigation into alleged corruption and maladministration at Tembisa Hospital.

The unit alleges that close to R2 billion was stripped from the healthcare facility, with Maumela allegedly at the centre of a syndicate involved in the looting.

SIU spokesperson, Selby Makgotho, says the preservation order aims to safeguard assets allegedly linked to the investigation while the legal process runs its course.

Makgotho says the curator approached the Special Tribunal in August to have the Ferrari sold.

“The continued storage, insurance and maintenance of the vehicle imposed ongoing costs.”

He says selling the Ferrari would protect its value while generating funds to maintain other assets already placed under curatorship.

The SIU says the latest ruling is another step towards ensuring that assets allegedly acquired through the proceeds of wrongdoing do not lose value while investigations and legal proceedings continue.
