Popular TikToker and MK Party member, Nkululeko “Max” Makhanya, who was arrested for allegedly insulting and swearing at KwaZulu-Natal Commissioner, Nhlanhla Mkhwanazi, has been granted R7000 bail.

Makhanya appeared in the Durban Magistrate’s Court today on charges of crimen injuria and inciting violence.
Police arrested him at Princess Magogo Stadium in KwaMashu yesterday evening while he was attending an MK Party rally.
The 38-year-old had posted a video accusing the provincial police commissioner of remaining silent while police officers in KwaZulu-Natal allegedly violate the rights of people seeking to protest. He also accused Mkhwanazi of smoking cannabis.

As part of his bail conditions, Makhanya is prohibited from directly and indirectly inciting members of the public to commit acts of violence.
The matter will return to court on 20 January 2027.
Makhanya’s arrest also comes as Mkhwanazi is being considered for the position of head of the Hawks.
Last week, Police Minister Firoz Cachalia, announced the proposed appointment of Mkhwanazi to the top position, previously held by retired police officer, Dr Godfrey Lebeya.
Although Mkhwanazi has indicated that he is not interested in the position, President Cyril Ramaphosa, has confirmed that his name has been put forward and that the matter will now be considered by Cabinet.
“Cabinet will be meeting and when Cabinet has decided, the announcement will be made, and that is a Cabinet process. I am sure you want to know what Cabinet is going to decide, but we do not disclose what Cabinet is going to decide. We only disclose afterwards.”
