Impeachment committee says its work will continue despite court challenge

Chairperson of the Parliament’s Impeachment Committee, Makashule Gana, says the committee’s work will continue despite President Cyril Ramaphosa’s legal challenge.

His remarks come after the Western Cape High Court reserved judgment in the Ramaphosa’s urgent application to interdict the impeachment proceedings against him.

The President approached the courts, arguing that the parliamentary process should be suspended pending the outcome of his review application challenging the Section 89 independent panel’s report, which found that he may have a case to answer over the Phala Phala farm scandal.

The panel, led by former Chief Justice, Sandile Ngcobo, found that there was prima facie evidence that Ramaphosa may have breached his constitutional oath in connection with the multi-million dollar theft at his Limpopo farm in 2020.

Through his legal team, Ramaphosa maintains that he is not seeking to avoid accountability but is instead seeking a postponement to allow the court to first determine a legal issue related to the impeachment process.

Meanwhile, Gana says the committee expects to have clarity by 22 July on who will lead evidence during the proceedings.

“The work of the committee so far is the preparatory work, so the appointment of the evidence leaders,  the preparation of the witnesses, the finalisation of the terms of reference, and all the work ; they are not seeking to interdict it. But in any case, we’re not going to stop until the court has decided, but the work continues.”

“We are now looking at the nominations of the evidence leaders, so we have received nominations from the political parties, as we indicated that political parties will make nominations.”

“So I’ve also had a conversation with the  Constitutional Legal Services Office to say that they must start looking at the nominees that have come from the political parties.”
