Joe Sibanyoni extortion case back on court roll

Taxi tycoon, Joe Sibanyoni, and his co-accused are expected to hand themselves over to police on Thursday before appearing in the Delmas Magistrate’s Court.

This comes after the National Prosecuting Authority (NPA) re-enrolled the extortion case against the accused.

The matter was struck off the roll last week in the Kwaggafontein Magistrate’s Court after the state prosecutor failed to appear, sparking widespread public criticism and renewed concerns over the handling of the case.

The accused face charges of money laundering and extortion involving a prominent mining businessman between 2022 and 2025. Lawyers for the accused, however, maintain that the complainant and the accused had a longstanding business relationship.

National Director of Public Prosecutions (NDPP), Advocate Andy Mothibi, expressed that the magistrate’s conduct in striking the matter off the roll and charging the state prosecutor with being in contempt of court was injudicious.

Mothibi confirmed that the NPA has lodged a complaint with the Magistrate Commission.

“As a judicial officer, there is some prudence that is expected, so we are of the view that her conduct on that day doesn’t measure up to that standard, and that’s why we are taking it to the Magistrate’s Commission.”

“With regard to the legality, the compliance with the law in dealing with this matter, we are also taking this matter on appeal with regard to her to her order, and the papers have been filed so we’ll take that process,” he added.

Mothibi also revealed that the state prosecutor allegedly feared for his life on the day of the court appearance.

“He got information on his way to court and that he was going to be killed and he turned back right and and and and the messages were sent to the DPP’s office.”
