NPA declines to prosecute in fatal Emmarentia road rage shooting – for now

The National Prosecuting Authority (NPA) has, for now, declined to prosecute a 58-year-old man arrested in connection with a fatal road rage shooting in Emmarentia, Johannesburg.

The suspect, who was expected to make his first appearance at the Johannesburg Magistrate’s Court on Tuesday, will not be formally charged at this stage as investigations continue.

NPA spokesperson, Magaboke Mohlatlole, says the decision follows a review of the available evidence, with prosecutors indicating that the matter may still be reinstated.

“After careful consideration of the evidence, the NPA has decided not to proceed with prosecution at this stage pending further investigations. The matter may be reinstated once investigators are satisfied that there is enough evidence to proceed.”

The case stems from a deadly incident that unfolded on Sunday afternoon, reportedly triggered by a bumper-bashing in Emmarentia.

Police say what began as a verbal altercation between two male drivers quickly escalated into a physical confrontation.

Authorities allege that a female passenger, believed to be the wife of one of the drivers, retrieved a firearm from a vehicle during the dispute. The second driver is also said to have drawn his own weapon, resulting in a shootout.

One man was fatally shot in the incident, while the other driver sustained minor injuries. The female passenger was also wounded and taken to hospital.

Police have opened cases of murder and attempted murder, and investigations remain ongoing.

Earlier in the day, proceedings at the Johannesburg Magistrate’s Court were delayed as the media awaited clarity from the prosecution, with the chief prosecutor said to have been in consultations before the decision was announced.

Meanwhile, a memorial service for the deceased is expected to take place, amid reports that his remains may be repatriated to Pakistan.

Authorities have urged motorists to remain calm, obey traffic laws, and avoid confrontations on the road to prevent similar incidents.
