The murder trial involving the parents of four-year-old “Baby Nikita” has been delayed yet again, with the Johannesburg High Court unable to proceed after another ongoing trial took priority.
Judge William Karam told the court on Monday that a directive from the Acting Deputy Judge President required him to prioritise the part-heard matter involving four accused, which is expected to occupy the courtroom until 26 October.
The latest postponement adds to delays in a case involving allegations of severe physical and sexual abuse against the Eldorado Park girl, who died in hospital in August last year.
“This court then will not be in a position to entertain your trial due to the fact that the part-heard needs, well, it takes priority and that trial will proceed from tomorrow until the 26th of October. So, this court is not in a position to entertain your matter,” Judge Karam said.
The matter has been postponed to Tuesday to allow the state and court roll planners to establish whether another judge is available to hear the case.
“It was discussed with counsel that, in the circumstances, the best option is that your matter roll until tomorrow in order that counsel for the state, including the roll planner, may conduct further inquiries as to the possible availability of another judge to deal with your trial,” added Judge Karam.
The trial was initially scheduled to begin last week but has been held up by administrative challenges and competing court commitments.
The case stems from an incident on 6 August 2025, when police allegedly found the child unconscious with severe head trauma.
Her father faces charges including murder and rape, while her mother is accused of failing to report the alleged abuse. The father is also accused of assaulting the couple’s three-year-old son.
Both parents remain in custody as the court seeks a way forward.
The identities of the accused and the deceased child remain withheld by court order to protect the surviving sibling.
The matter is expected to return to the Johannesburg High Court on Tuesday, when the parties will establish whether another judge is available to hear the trial.
