Suspended Deputy National Commissioner, Shadrack Sibiya, says the rape and trafficking charges against him are part of a ploy to force him out of the South African Police Service (SAPS).
The 59-year-old, who is facing the charges in court, maintains that he is being targeted and has denied the allegations against him.
Sibiya appeared in the Randburg Magistrates Court on Tuesday, where he applied for R20 000 bail.
The state alleges that Sibiya took an 18-year-old woman and her friends to a strip club, bought them alcohol and later raped her while she was unconscious.
Sibiya also told the court that he had consensual sexual intercourse with the 18 year old. He denies having raped her.
He is also accused of asking a 16-year-old girl to send him explicit content.
Sibiya denies raping the 18-year old and told the court that the sexual intercourse between them was consensual.
He further claims the teenager’s father had told him that she has a crush on him.
His lawyer argued that Sibiya’s release on bail would not pose a threat to witnesses, despite reports that witnesses received intimidating messages ahead of his previous court appearance.
Sibiya, through his lawyer, has undertaken not to contact or communicate with any state witnesses.
“I wish to add the identities of most of the said witnesses are unknown to me. I cannot, however, be held accountable if any member of the public and/or persons known to me independently express their own views in public or on social media platforms regarding witnesses and all the charges I’m facing.”
Sibiya also rejected suggestions that he was linked to any attempts to influence witnesses.
“It is apparent that the state is tempting to impute third-party conduct on me by insinuating that a cabal exists and that I form part of same. I’ve never requested nor instructed any person to influence and or contact any witnesses in this matter. I submit that should any allegations in this regard be made by the state same will be vehemently denied and challenged.”

Meanwhile, SAPS has served Sibiya with a notice to attend a disciplinary hearing on 5 October over allegations arising at the Madlanga Commission.
National police spokesperson, Athlenda Mathe, says they will be guided by the court on where the hearing will be held as the cop is detained at the Kgosi Mampuru Correctional Facility.
“If he is still in custody, we will then organise with Correctional Services to allow that particular hearing to sit in Kgosi Mampuru on the 5th of October. If he is out on bail, the venue where this particular hearing will sit will be communicated to him.”
Mathe confirmed that Sibiya will face an expeditious disciplinary process under Regulation 9.
“Allegations of corruption do fall under that category, and it’s quite serious allegations that he is facing, and I can then again confirm that Monday is the set date for this expeditious hearing.”
