The family of four-year-old, Nada-Jane Challita, says the justice system is failing them, as delays continue to stall sentencing proceedings for her convicted killer, Amber-Lee Hughes, in the Johannesburg High Court.
Her father, Ellie Challita, was expected to take the stand on Wednesday, but the matter was postponed yet again due to the unavailability of the presiding judge.
Despite both the State and the defence indicating they were ready to proceed, the court heard that scheduling conflicts involving Judge Richard Mkhabela, have once again halted proceedings. State prosecutor, Rolene Barnard, confirmed that a new court date has been set for 19 June, with efforts underway to resume earlier if the judge becomes available.
“We are going to request that the matter be postponed to the 19th of June and the accused to remain in custody. We are trying to arrange a virtual meeting with Judge Mkhabela within this week regarding further dates, earlier dates or later dates during recess. In the event that we manage to secure dates prior to the 19th, because we did previously arrange dates prior to the 19th,” said Bernard.
The court also noted ongoing logistical challenges, including the difficulties coordinating multiple witnesses in a single sitting, raising further concerns over continued delays in finalising sentencing.
Frustration and emotional strain were evident in court, as the repeated postponements continue to take a toll on the child’s family. Ellie Challita described the delays as deeply painful, saying each postponement reopens old wounds.
“Our life is still on hold. And every time we get promised that we’re gonna have some progress, there’s no such thing. You can see, we just keep postponing and postponing. Regardless, what’s the reason? We are still hanging in the middle of this. Our life is still hanging,” he said.
He also questioned the prioritisation of court proceedings, suggesting that civil matters appear to be taking precedence over his daughter’s case.
Amber-Lee Hughes, who was convicted of raping and murdering the child, remains in custody as the family continues to wait for sentencing and for justice to be served.
