Sean ‘Diddy’ Combs’s fight for freedom is intensifying, as his legal team moves ahead with an appeal to overturn his 50-month prison sentence.

The 56-year-old was sentenced in October last year after being found guilty of transportation to engage in prostitution, but was acquitted of racketeering and sex trafficking charges.

At the centre of the appeal is the argument that the activities described in the case, referred to as “freak-offs”, should be viewed as protected expression rather than criminal conduct.

The defence argued that these encounters, along with so-called “hotel nights”, fall under free expression and should not be prosecuted under current federal statutes.

The music mogul’s attorneys described the gatherings as “highly choreographed sexual performances”, drawing comparisons to amateur pornography, which they say has historically been under the Constitution.

Prosecutors, however, have argued that Combs ran a criminal enterprise between 2004 and 2024, allegedly abusing, threatening and coercing victims to fulfil his sexual demands.

The seven-week trial saw gruelling testimony from a number of several witnesses, including his ex-girlfriend and R&B singer Cassie Ventura.

The two lovers met when Cassie was 19, and Diddy was 37, before signing her to his Bad Boy Records label.

Ventura gave chilling testimony during the trial, alleging that Diddy coerced her into a marathon of “freak off” parties and endured abuse during the 11-year relationship.

She further told the court that she got hooked on drugs during the relationship, using it as a tool to numb her pain during the encounters, where Diddy would also record her with male escorts.

Combs is currently serving his sentence and is expected to be released in 2028.
