Outrage over acquittal of ex-Stellenbosch student in urine scandal

The acquittal of former Stellenbosch University student, Theuns du Toit, has sparked widespread controversy.

Du Toit was caught on video urinating on the belongings of a Black student, Babalo Ndwayana, an incident that drew national outrage and reignited conversations around racism at institutions of higher learning in the country.

The court ruled that there were inconsistencies in Ndwayana’s testimony and that the State failed to prove intent, particularly, after it was revealed that du Toit was intoxicated at the time of the incident.

While the university expelled du Toit following an independent disciplinary hearing that found him guilty of racism and breaching the student code of conduct, his legal team has maintained that the criminal charges were baseless.

His lawyer says they managed to prove that the laptop  and books were not damaged.

The South African Student Congress (SASCO) has since called for a thorough investigation into the matter, saying the outcome raises serious concerns about justice in cases involving racial discrimination.

The student organisation’s Thuto Mashile says urinating on someone’s belongings is a disturbing act that causes emotional distress and humiliation.
“It is disheartening to see that such incidents occur within institutions that claim to uphold values of respect and inclusivity. The fact that some institutions like Stellenbosch may still struggle with transformation and inclusivity is concerning.”

The ruling has been met with criticism from various quarters, with many questioning the message it sends about accountability and racial justice.
