Research and Advocacy Officer at Judges Matter, Mbekezeli Benjamin, says the man who is caught on camera threatening a magistrate in court could face charges of contempt of court.
In this rare incident, the accused is making demands and threatening to halt proceedings unless his conditions are met.
In a video shared by PSAFLIVE on X, the man believed to be a Nigerian national is telling the magistrate that no trial will take place unless his laptop is returned to his family.
“I will not return to this court for anything,” he declared.
He also appears angry over an official whom he has laid a complaint against to still be working.
Benjamin described this behaviour as completely unacceptable, emphasising that it should never be tolerated.
“It undermines the authority of the judiciary and the administration of justice,” he added.
“Judicial ethics require judges and magistrates to treat all individuals with respect, and court users must equally show respect towards judicial officers.”
Benjamin further noted that the man could be sentenced to at least 30 days in prison for contempt of court and the presiding magistrate or judge has the right to take action to protect the dignity of the court.
