Magudumana loses another bid to challenge her arrest in Tanzania

Dr Nandipha Magudumana has been dealt another blow after the High Court in Bloemfontein dismissed her application for leave to appeal, with costs.

The disgraced doctor approached the courts in a bid to challenge her April arrest in Tanzania.
She claims she was brought back to South Africa unlawfully and her deportation was tantamount to kidnapping.
Magudumana was arrested alongside her lover Thabo Bester in Arusha.
Last month, the High Court in Bloemfontein dismissed her application to have her arrest declared unlawful.
Delivering Tuesday’s ruling, Judge Phillip Loubser found that there are no reasonable prospects of success in declaring Home Affairs’ conduct unconstitutional.
“Having regard to all the submissions made on behalf of the applicant, I am of the view that those submissions cannot be successful in light of the findings of facts made by this court in the application launched by the applicant.
“I am therefore not persuaded that another court would come to a different conclusion or that there are other compelling reasons why the matter should proceed on appeal,” says Loubser.
Magudumana is currently in police custody on charges of defeating the ends of justice as well as aiding and abetting a prisoner to escape from lawful custody.
The doctor and her lover made headlines when they fled South Africa after news that the Facebook rapist and murderer escaped from prison.

At least 12 people have been arrested in connection with Bester’s brazen escape, including the doctor’s father and former G4S employees.
