Dr Nandipha Magudumana will have to wait until next week to find out whether her urgent bid to have her arrest in Tanzania declared unlawful has been successful.
The disgraced medical practitioner made a brief appearance in the Bloemfontein High Court today and the matter was rolled over to Thursday.
This was done in order to afford respondents in the matter, including the Department of Home Affairs, time to file their papers and Dr Magudumana’s team to file responding documents.
The Department of Home Affairs will its file papers on Monday.
The celebrity doctor is facing various charges, including abetting her lover – convicted rapist and murderer, Thabo Bester, escape from lawful custody.
Dr Magudumana is seeking immediate release from police custody and that her arrest be declared unlawful.
YNews Reporter Naomi Kobbie was in court and filed the below report:
Leg to stand on
Legal expert, Advocate Sheldon Magardie, says Dr Magudumana may have a leg to stand on if the law wasn’t exercised correctly during her arrest.
Magardie says the law makes it clear that the state must follow the correct procedures when extraditing an alleged criminal from another country.
Magudumana and Bester were arrested in the wee hours of the night in Tanzania last month, along with a Mozambican national who was allegedly assisting them.
It is suspected that the lovers were plotting their next escapade to another country, as they were found with multiple passports in their possession.
