MK Party wins trademark battle against the ANC

Umkhonto weSizwe Party (MK Party) has won the trademark battle against the ANC.

The high court in Durban today dismissed, with costs, the governing party’s bid to stop former Jacob Zuma’s party from using its name and logo.

The ANC had argued that the MK Party wants to confuse voters on May 29 by using part of its heritage and intellectual property, while the new kid on the political block asserted that the ANC does not own rights to MK Party’s name and logo.

Today’s ruling came just a few weeks after the ANC lost an application for the Electoral Court in Johannesburg to set aside the MK Party’s registration with the IEC.

MK Party founder, Jabulani Khumalo, has warned the governing party that they will beat them at the courts again should they try launching another legal bid against them.

The ANC will brief the nation on the developments this afternoon.
