The Economic Freedom Fighters (EFF) says Dr Mbuyiseni Ndlozi has been vindicated after a court ruled in his favour over untested rape allegations.
The EFF MP had taken the Daily Sun newspaper to court over its 2021 report that alleged he had raped someone.
The publication has been ordered to apologies and remove the statements from all its platforms within seven days.
It was established in court that the Daily Sun was never in possession of the victim’s statement, but had allegedly received a tip off from a police source.
However, days after the story was printed, SAPS spokesperson, Brigadier Mathaphelo Peters, confirmed through a media statement that there was a rape case opened, but Ndlozi was not the suspect.
The EFF has welcomed the court’s decision, with spokesperson Sinawo Tambo saying the judgment must, however, never be weaponised to defend perpetrators of crimes against women.
The party is urging GBV victims to continue to explore legal and political means to confront the war on women and children.

The red berets say the unprecedented judgment actually benefits and protects gender-based violence cases.
