Dr Nandipha Magudumana’s legal team is taking the fight to have her released from jail to the Supreme Court of Appeals.
The disgraced celebrity medic’s team says they are in the process of filing the court papers.
Earlier, the high court in Bloemfontein dismissed with costs – Dr Magudumana’s urgent application to have her arrest in Tanzania declared unlawful.
Judge Philip Loubser said Magudumana did not meet the criteria for launching the application on an urgent basis.
Judge Loubser further stated that there is no hesitation that she was aware of the charges that would be levelled against her back home in South Africa.
Dr Magudumana had accused the Home Affairs Department along with the police of abducting her from Tanzania, along with her lover Thabo Bester, who is a convicted murderer and rapist.
When they were nabbed, the couple was in Arusha in April along with a Mozambican national.
They were found in possession of several passports that did not have any stamps on them, sparking suspicions that they were about to flee to Kenya as they were 10km away from the Kenyan border.
The Department of Home Affairs was one of the government departments that opposed her bid for freedom.
While welcoming the court’s ruling, Minister Dr Aaron Motsoaledi expressed concern over the Judge’s assertion that his department extradited Magudumana from Tanzania.
Dr Nandipha Magudumana, her six co-accused and lover Thabo Bester are expected back in court on the 20th of June over Bester’s 2021 escape from prison.
